Successful NIHL compensation for scaffolder exposed to noise

Our client was employed for over 40 years as a scaffolder and also carrying out the construction and labouring work.
Our client had been employed by a number of different employers over his working life. This is typical of construction workers who often move from job to job as different construction projects are completed by different companies.
One of the challenges facing us in this claim, therefore, was to identify all of our client’s former employers and to ensure that we also traced insurance cover.
Tracing former employers and their insurers can often be a lengthy process particularly if the companies in question have closed down. In this case we were able to trace a number of our client’s previous employers and the insurance companies that provided cover to them, which allowed us to proceed with our client’s claim.
Once we had traced the various insurers we then had to establish that our client’s hearing loss had occurred as a result of his exposure to excessive noise in his various jobs.
Whilst our client worked primarily as a scaffolder he usually worked surrounded by excessive levels of noise from various tasks being undertaken on construction sites. He worked in close proximity to large cranes, cutting machines, generators, jackhammers and diggers during his various employments. These gave rise to considerable levels of noise.
Ultimately we were able to successfully establish that our client’s hearing loss had been caused by the noise he had been exposed to during his working life and we were able to successfully pursue our client’s claim. The claim settled for the gross sum of £4,000.
