Compensation awarded to coal miner for hearing loss
What’s My Deafness Claim Worth have successfully pursued a claim for a Claimant who suffered noise induced hearing loss as a result of his employment as a coal miner.
Our client was employed by the National Coal Board for 35 years. He worked at the Westoe Colliery and the Ellington Colliery in the North East of England and was employed as a coal face worker and machine operator.
Our client was subjected to very loud noise during his employment as a coal miner. The machines that they used to cut the rock face and to mine the coal were extremely loud when they were in operation. These included machines such as the Dosco Roadheader and the Lenorse Miner.
The level of noise our client was exposed to was such that he would not have been able to have any form of conversation with colleagues standing next to him, even if he shouted.
Our client was not provided with any hearing protection at all by the National Coal Board and he found that he would often return home from work with ringing in his ears, although this would stop by the end of the day.
Several years after his employment ceased our client started to notice that he had problems with his hearing. He started having to turn the television volume up louder than other people needed it. He also struggled to hear people when speaking on the telephone or speaking to anyone when there was background noise.
We accepted instructions from our client to pursue his claim for noise induced hearing loss and were able to successfully pursue our client’s claim against the Secretary of State for Energy & Climate Change, who is now responsible for claims such as this as the National Coal Board is no longer in existence. Our client received £2,500 as compensation for his condition.
