Deafness claim settled using the claims portal

We have successfully settled a noise induced hearing loss claim for Mr R who contacted us after seeing our advertisement in the paper.

Around a year before he contacted us, Mr R had noticed that he was suffering with hearing loss and tinnitus and upon seeing our advertisement he connected his hearing problems to his previous noisy work.

Mr R had only been exposed to noise at one employer, British Telecom (BT). He began working for BT in 1969 as a cable jointer and faultsman. He was initially based at GPO on Lytton Street, Middlesbrough, but when this was shut down, he moved to Southerby Road, Middlesbrough and he finally ended worked for the company at Marton Road, Middlesbrough.

His job involved travelling to various locations to find faults in the underground cable network at both domestic and commercial properties. To find a fault, Mr R used an Ohm meter to locate the general area of the fault and then used a tone set to find the specific fault in the wires. This was done using the process of elimination, stripping back the insulation on the wires and touching them together to see if the beeping from the headset would stop. For this whole process, Mr R had to listen to a continuous beeping noises through his headset. This continued throughout his 36 year period of employment with BT.

Mr R was never warned of the dangers of being exposed to excessive noise.

As Mr R was only exposed to excessive noise with one employer, Mr R’s claim had to be submitted through the Claims Portal. The Claims Portal was initially introduced in 2010 for Road Traffic Accident claims and in 2013 was opened up to other types of personal injury claim, including industrial disease claims such as those relating to noise induced hearing loss. The Portal allows information to be passed straight to insurers and aims to increase speed and efficienty whilst also reducing solicitor costs.

We arranged for Mr R to attend a medical appointment with a respected medical expert who provided us with a report which supported the noise induced hearing loss claim.

The claim for his hearing loss compensation settled for £6,500 and was concluded within eight months.
